  3. PLEASE READ THIS LICENSE CAREFULLY BEFORE USING THE SOFTWARE. BY USING THE
  4. SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO
  5. NOT AGREE TO THE TERMS OF THIS LICENSE, PROMPTLY RETURN THE UNUSED SOFTWARE TO
  6. THE PLACE WHERE YOU OBTAINED IT AND YOUR MONEY WILL BE REFUNDED.

  8. 1. License. The application, demonstration, system and other software
  9. accompanying this License, whether on disk, in read only memory, or on any other
  10. media (the "Software") the related documentation and fonts are licensed to you by
  11. the Association for Computing Machinery, Inc. "ACM". You own the disk on which
  12. the Software and fonts are recorded but the Association for Computing Machinery,
  13. Inc. "ACM" and/or the Association for Computing Machinery, Inc. "ACM"'s Licensors
  14. retain title to the Software, related documentation and fonts. This License
  15. allows you to use the Software and fonts on a single Apple computer and make one
  16. copy of the Software and fonts in machine-readable form for backup purposes only.
  17. You must reproduce on such copy the Association for Computing Machinery, Inc.
  18. "ACM" copyright notice and any other proprietary legends that were on the
  19. original copy of the Software and fonts. You may also transfer all your license
  20. rights in the Software and fonts, the backup copy of the Software and fonts, the
  21. related documentation and a copy of this License to another party, provided the
  22. other party reads and agrees to accept the terms and conditions of this License.

  24. 2. Restrictions. The Software contains copyrighted material, trade secrets and
  25. other proprietary material. In order to protect them, and except as permitted by
  26. applicable legislation, you may not decompile, reverse engineer, disassemble or
  27. otherwise reduce the Software to a human-perceivable form. You may not modify,
  28. network, rent, lease, loan, distribute or create derivative works based upon the
  29. Software in whole or in part. You may not electronically transmit the Software
  30. from one computer to another or over a network

  32. 3. Termination. This License is effective until terminated. You may terminate
  33. this License at any time by destroying the Software, related documentation and
  34. fonts and all copies thereof. This License will terminate immediately without
  35. notice from the Association for Computing Machinery, Inc. "ACM" if you fail to
  36. comply with any provision of this License. Upon termination you must destroy the
  37. Software, related documentation and fonts and all copies thereof.  4. Export Law
  38. Assurances. You agree and certify that neither the Software nor any other
  39. technical data received from the Association for Computing Machinery, Inc. "ACM",
  40. nor the direct product thereof, will be exported outside the United States
  41. except as authorized and as permitted by the laws and regulations of the United
  42. States. If the Software has been rightfully obtained by you outside of the United
  43. States, you agree that you will not re-export the Software nor any other
  44. technical data received from the Association for Computing Machinery, Inc. "ACM"
  45. , nor the direct product thereof, except as permitted by the laws and regulations
  46. of the United States and the laws and regulations of the jurisdiction in which
  47. you obtained the Software.

  49. 5. Government End Users. If you are acquiring the Software and fonts on behalf of
  50. any unit or agency of the United States Government, the following provisions
  51. apply. The Government agrees: (i) if the Software and fonts are supplied to the
  52. Department of Defense (DoD), the Software and fonts are classified as "Commercial
  53. Computer Software" and the Government is acquiring only "restricted rights" in
  54. the Software, its documentation and fonts as that term is defined in Clause
  55. 252.227-7013(c)(1) of the DFARS; and (ii) if the Software and fonts are supplied
  56. to any unit or agency of the United States Government other than DoD, the
  57. Government's rights in the Software, its documentation and fonts will be as
  58. defined in Clause 52.22719(c)(2) of the FAR or, in the case of NASA, in Clause
  59. 18-52.227-86(d) of the NASA Supplement to the FAR.

  61. 6. Limited Warranty on Media. the Association for Computing Machinery, Inc. "ACM"
  62. warrants the diskettes and/or compact disc on which the Software and fonts are
  63. recorded to be free from defects in materials and workmanship under normal use
  64. for a period of ninety (90) days from the date of purchase as evidenced by a copy
  65. of the receipt. the Association for Computing Machinery, Inc. "ACM" 's entire
  66. liability and your exclusive remedy will be replacement of the diskettes and/or
  67. compact disc not meeting the Association for Computing Machinery, Inc. "ACM" 's
  68. limited warranty and which is returned to the Association for Computing
  69. Machinery, Inc. "ACM" or an the Association for Computing Machinery, Inc. "ACM"
  70. authorized representative with a copy of the receipt. the Association for
  71. Computing Machinery, Inc. "ACM" will have no responsibility to replace a
  72. disk/disc damaged by accident, abuse or misapplication. ANY IMPLIED WARRANTIES ON
  73. THE DISKETTES AM)/OR COMPACT DISC, INCLUDING THE IMPLIED WARRANTIES OF
  74. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO
  75. NINETY (90) DAYS FROM THE DATE OF DELIVERY. THIS WARRANTY GIVES YOU SPECIFIC
  76. LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY BY JURISDICTION.

  78. 7. Disclaimer of Warranty on Apple Software. You expressly acknowledge and agree
  79. that use of the Software and fonts is at your sole risk. The Software, related
  80. documentation and fonts are provided "AS IS" and without warranty of any kind and
  81. the Association for Computing Machinery, Inc. "ACM" and the Association for
  82. Computing Machinery, Inc. "ACM" 's Licensor(s) (for the purposes of provisions 7
  83. and 8, the Association for Computing Machinery, Inc. "ACM" and the Association
  84. for Computing Machinery, Inc. "ACM" 's Licensor(s) shall be collectively referred
  85. to as "the Association for Computing Machinery, Inc. "ACM" ") EXPRESSLY DISCLAIM
  86. ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
  87. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. the
  88. Association for Computing Machinery, Inc. "ACM" DOES NOT WARRANT THAT THE
  89. FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT THE
  90. OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN
  91. THE SOFTWARE AND THE FONTS WILL BE CORRECTED. FURTHERMORE, the Association for
  92. Computing Machinery, Inc. "ACM" DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS
  93. REGARDING THE USE OR THE RESULTS OF THE USE OF THE SOFTWARE AND FONTS OR RELATED
  94. DOCUMENTATION IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.
  95. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY the Association for Computing
  96. Machinery, Inc. "ACM" OR AN [ LICENSEE NAME] AUTHORIZED REPRESENTATIVE SHALL
  97. CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY. SHOULD THE
  98. SOFTWARE PROVE DEFECTIVE, YOU (AM) NOT the Association for Computing Machinery,
  99. Inc. "ACM" OR AN the Association for Computing Machinery, Inc. "ACM" AUTHORIZED
  100. REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR
  101. CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES,
  102. SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

  104. 8. Limitation of Liability. UNDER NO CIRCUMSTANCES INCLUDING NEGLIGENCE, SHALL
  105. the Association for Computing Machinery, Inc. "ACM" BE LIABLE FOR ANY INCIDENTAL,
  106. SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OR INABILITY TO USE THE
  107. SOFTWARE OR RELATED DOCUMENTATION, EVEN IF the Association for Computing
  108. Machinery, Inc. "ACM" OR AN the Association for Computing Machinery, Inc. "ACM"
  109. AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  110. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR
  111. INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT
  112. APPLY TO YOU. In no event shall the Association for Computing Machinery, Inc.
  113. "ACM" 's total liability to you for all damages, losses, and causes of action
  114. (whether in contract, tort (including negligence) or otherwise)- exceed the
  115. amount paid by you for the Software and fonts.

  117. 9. Controlling Law and Severability. This License shall be governed by and
  118. construed in accordance with the laws of the United States and the State of
  119. California, as applied to agreements entered into and to be performed entirely
  120. within California between California residents. If for any reason a court of
  121. competent jurisdiction finds any provision of this License, or portion thereof,
  122. to be unenforceable, that provision of the License shall be enforced to the
  123. maximum extent permissible so as to effect the intent of the parties, and the
  124. remainder of this License shall continue in full force and effect.

  126. 10. Complete Agreement. This License constitutes the entire agreement between the
  127. parties with respect to the use of the Software, the related documentation and
  128. fonts, and supersedes all prior or contemporaneous understandings or agreements,
  129. written or oral, regarding such subject matter. No amendment to or modification
  130. of this License will be binding unless in writing and signed by a duly authorized
  131. representative of the Association for Computing Machinery, Inc. "ACM" .
